1. Agreement
These terms apply to internet access supplied by NM Internet LLC to the customer named on the account. Placing an order or using the service constitutes acceptance.
2. Service and speeds
Speeds quoted are the typical speeds achievable on your plan, measured to our network edge as described in the Broadband Facts label for that plan. Fixed wireless performance depends on line of sight, distance to the serving tower and weather. We do not guarantee an uninterrupted or error-free service on residential plans.
3. Term and cancellation
Residential service is month to month with no minimum term and no early termination fee. Either party may cancel with 30 days’ notice. Business plans with a service level agreement may carry an agreed term, stated on the order form.
4. Charges
Charges are billed monthly in advance and are due 21 days from the invoice date. Late fees, returned payment fees and reconnection fees are published on our billing page. Government taxes and regulatory fees are additional.
5. Equipment
Equipment installed by us and not purchased outright remains our property and must be returned in working order within 30 days of cancellation, or an unreturned equipment charge applies. Do not relocate, modify or re-point outdoor equipment yourself.
6. Installation and access
You confirm you are entitled to authorize installation at the address, including landlord consent where needed, and will give our technicians safe access to complete and maintain the work.
7. Acceptable use
Your use of the service is subject to our Acceptable Use Policy.
8. Suspension
We may suspend service for non-payment after written notice, for breach of the acceptable use policy, or where required by law. We will restore service promptly once the cause is resolved.
9. Liability
Our liability for any claim is limited to the charges paid for the service in the month concerned. We are not liable for indirect or consequential loss. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Governing law
These terms are governed by the laws of the State of New Mexico.
